Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from journeymakr.com (the “Site”).

As a white-label platform provider, we understand the importance of protecting the privacy and personal information of the customers ("End Users") of our customers ("Customers") who utilise our platform. “Personal Information” is information that identifies you, or information by which your identity can reasonably be ascertained. 

The Site is bound to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”) that regulate the handling of personal information about individuals. This Privacy Policy section outlines how we handle the privacy of End Users' data while using our services. 

1. Collection and Use of Personal Information

a. We may collect certain personal information from End Users as authorised by the Customers for the purpose of providing our services. This information may include, but is not limited to, names, contact details and booking dates. 

b. We will only use the collected personal information for the purpose of providing the requested services, as specified by the Customers. We do not sell or share this information with any third parties, except as required by law or with the explicit consent of the End User.

2. Data Security

a. We employ reasonable technical and organisational measures to protect End Users' personal information against unauthorised access, loss, alteration, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security of personal information. 

b. We will promptly notify Customers in the event of any data breach affecting the personal information of End Users and will assist the Customers in complying with their legal obligations, as applicable. 

3. Data Retention

a. We will retain End Users' personal information only for as long as necessary to fulfil the purposes outlined in this Privacy Policy section or as required by law. Once the purpose of data collection is fulfilled, we will securely dispose of or anonymise the personal information.

4. End User Rights

a. End Users may exercise their rights concerning their personal information as provided by applicable data protection laws. This includes the right to access, rectify, erase, restrict, or object to the processing of their personal information. To exercise these rights, End Users should directly contact the Customers who have collected their personal information. 

b. As a white-label platform provider, we will assist our Customers in fulfilling their obligations regarding End User rights, as specified in applicable data protection laws. 

5. Updates and Changes 

a. We reserve the right to update or modify this Privacy Policy section at any time. We will notify the Customers of any material changes through appropriate means. Continued use of our platform by the Customers or their End Users after the notification of changes will constitute acceptance of the updated Privacy Policy. 

6. Governing Law 

a. This Privacy Policy section is governed by and construed in accordance with the laws of Australia. Any disputes arising out of or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the courts of Australia.

b. By utilising our white-label platform, the Customers acknowledge that they have read, understood, and agreed to the terms of this Privacy Policy section. The Customers also undertake to ensure that their End Users are provided with clear and transparent information regarding the processing of their personal information in accordance with applicable data protection laws.

7. Personal Information we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

8. We collect Device Information using the following technologies:

a. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

b. “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

c. “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

9. How we use your personal information

a. We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: 

Communicate with you;

Screen our orders for potential risk or fraud; and

When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimise our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

10. Sharing your personal information

a. We share your Personal Information with third parties to help us use your Personal Information, as described above. b. We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

11. Behavioural advertising

a. As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 12. No tracking

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

13. EU Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

14. Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

15. Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
